MITCHELMORE JA: The respondent, George Hanna, was the named insured in a policy of insurance with the appellant insurer, AIG Insurance Ltd (AIG). The insurance policy related to a construction project located in Seventh Avenue, Campsie (the Project). On 18 October 2018, a formworker on the Project, Kahlil Hasan, was injured when he slipped and fell from a height whilst walking on the scaffolding. Mr Hasan commenced proceedings against Mr Hanna in the District Court, seeking damages for negligence and breach of statutory duty.
